Terms of Service
The terms that govern your access to and use of Phynix.
Last updated:
1. About these terms
Phynix is a habit companion by Zatricx. These Terms of Service govern your use of the Phynix website, waitlist, and app. By using the service, you agree to these terms. If you do not agree, do not use the service. Our Privacy Policy explains how we handle personal information.
2. Private beta and the waitlist
Phynix is in private beta. App access requires an invitation. Joining the waitlist requests an email when access is available; it does not create an account, guarantee an invitation, or promise a release date. We may change features, availability, or participation limits as we develop the service. Beta features may contain errors or experience interruptions.
3. Your account
Provide accurate information and use an email address you control. You are responsible for safeguarding your sign-in credentials and using your account lawfully. Do not share access in a way that allows another person to impersonate you or bypass access restrictions. Use Phynix only if you can enter into these terms under the laws that apply to you.
4. Appropriate use
You may use Phynix for personal habit-building and reflection. Do not use the service to harm or harass others, distribute unlawful content, infringe another person’s rights, introduce malicious software, or gain unauthorized access to accounts or data. Do not circumvent authentication, rate limits, or other security controls, or interfere with the service’s operation.
5. Your content
You retain ownership of the habits, reflections, notes, and other content you create. You give us permission to store, process, transmit, and display that content as necessary to provide the features you use, including synchronization and features involving service providers. You are responsible for having the rights needed to submit your content. Content you choose to post on the public feedback board is visible to others; do not post private information there.
6. Health information and AI features
Phynix supports personal habit-building and reflection. It does not provide medical, psychological, or other professional advice, diagnosis, or treatment. It is not an emergency service. Consult a qualified professional for decisions concerning your health. AI-generated suggestions and transcriptions may be inaccurate or incomplete. Review them before relying on them, and use your own judgment when choosing habits or acting on a suggestion.
7. Pricing and subscriptions
All available features are included at no charge during the current private beta. Joining the waitlist or using the beta does not start a paid subscription, and no payment card is required. If we introduce paid plans, we will present the price, billing period, renewal terms, and cancellation information before you make a purchase. We will not automatically convert your free beta access into a paid subscription.
8. Local data and availability
Phynix stores app data on your device and synchronizes supported data when you are signed in and connected. Clearing browser storage, changing devices, or using the service before synchronization finishes can affect access to local records. Use the export controls to keep copies of information important to you. We do not promise uninterrupted availability, error-free operation, or a particular personal outcome.
9. Third-party services
Some features rely on third-party authentication, hosting, storage, AI, notification, and other services. Those providers may have their own terms governing your direct use of their products. Our Privacy Policy describes the providers involved in processing information for Phynix. Links to third-party websites do not make their content or services part of Phynix.
10. Ending your use
You may stop using Phynix at any time. Account users can access data export and deletion controls in Settings → Data & Privacy. Account deletion and removal from the email waitlist are separate actions. We may restrict or suspend access when reasonably necessary to address abuse, a violation of these terms, a security risk, or a legal obligation. Ending access does not transfer ownership of your content to us.
11. Your legal protections
Nothing in these terms excludes or limits a right, remedy, warranty, or responsibility that cannot lawfully be excluded or limited. Any limitations described here apply only to the extent permitted by the law that applies to you.
12. Changes and support
We may update these terms as the service changes. The current version and revision date appear on this page. Where required, we will provide notice of material changes before they take effect. You may stop using the service if you do not agree to revised terms. For guidance on using Phynix and its account controls, visit the Help Center.
